MAXIM/Associates is happy to announce an important victory in a public procurement procedure regarding a relevant section of road in NW Romania, valued over 45 mil. Lei.
The Court of Appeal’s ruling validated the arguments of the team of lawyers, consisting of Andrei MAXIM and Alexandru FILIP, on how specific experience in public procurement contracts can be proven, including references to the requirements of the Contracting Authority, as set out in the requests for clarification.
This ruling modified the original decision of the National Council for the Settlement of Disputes (NCSD), which had downgraded our Client’s offer to second place, even though the Contracting Authority had initially designated it the winner of the procedure.
The Court's decision mentioned above is final and unappealable.
As a result of this solution, the initial ranking of the procurement procedure has been consolidated and our Client is in a position to successfully conclude and execute the procurement contract.
